Parents heartache over disabled children

by Dennis Gardener

No two cases in will writing are ever the same. That's what makes it interesting and I'm currently working with a parent who wants to make sure their disabled child is looked after financially when they are no longer around.

They have a will at present that was provided "free" by the solicitor when they bought their house but it does nothing to protect the child, who is unlikely ever to understand the concept of money and who would receive everything at 18 (better than the legal minimum of 16 I suppose!)

By adding a Disabled Discretionary Trust to the will the client has the piece of mind of knowing that their child will get the full advantage of the inherited estate, given to them by the trustees for major & minor incidentals (new coat, laptop, holiday) without losing any of the means tested benefits the “child” is eligible for.

The client is ecstatic and doesn't know why they weren't told this when they made their last will? As I pointed out the solicitor takes instruction, we as willwriters give advice and in getting to the root of the problem, we can give the solution to suit each individual case.
