Willwriting isn't for cowboys!

by Dennis Gardener

"Willwriters are cowboys" so proclaim many newspapers and radio & television programmes at the moment.

Well, its not true and very biased!

Some willwriters are cowboys like every other part of the willwriting profession from solicitors through to online providers, there are some real shysters out there.

Hence the regulation of the profession of Willwriting which is already law in Scotland as from last November and will come into full effect in 2012. In England the advice from last week's report by the Legal Services Consumer Panel is to go down the same route and I and other professional willwriters all say "Hurrah and about time too!"

If you look at the report by the Legal Services Consumer Panel just issued for England & Wales, Solicitors are equally at fault with the amount of wills that fail. Solicitors can write wills without having any formal training on the subject at all and that needs to be addressed.  But from the spin doctors & PR machine that are peddling the "doom & gloom", outing solicitors isn't newsworthy & they don't want to destabilise the general public's view of good old solicitors.

Some are great and I work alongside them writing wills for several solicitors practices who want a job done properly for their clients but don't specialise in it themselves.

I joined the Institute of Scottish Professional Willwriters (ISPW) when they were formed as an offshoot of the Institute of Professional Willwriters (IPW) and am proud to be a member. "Professional" is in our title and professionally we behave, we have to or we will be found out & kicked out! We have to pass entrance exams, have £2 million worth of Professional Indemnity Insurance in place, per document we draw up, do at least 20 hours of provable CPD per year, have our work checked over at least once every five years and have an independent complaints procedure. We are the only willwriters with Office of Fair Trading code approval which is rigorous in its requirements. I always did it properly now I have to prove I do it properly and feel comfortable that I am accountable.

Willwriters are not all cowboys but always make sure you use a member of the Institute either side of the border & if you want advice a bout who to use and I can't help, I will personally recommend a colleague who can. The important thing is to get the piece of mind of getting a correct will that deals with your wishes and will stand the test of time. Let me know if I can help?

"Before your deid use your heid!"

These views are my personnel views and not those of the ISPW or IPW
